By accessing or using Test Utopia ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
These terms constitute a legally binding agreement between you and Test Utopia Ltd (Reg. No. 207409973, VAT BG207409973), a company registered in Bulgaria with its registered office at Razsadnika-Konyiovitsa, Bl. 22, fl. 6, ap. 38, Sofia, 1330, Bulgaria ("Test Utopia", "we", "us"), regarding your use of the platform for technical assessment, code execution, and candidate evaluation purposes.
When creating an account, you agree to:
We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.
You agree not to use the Service to:
The Service, including all software, design, text, images, and trademarks, is owned by Test Utopia and protected by intellectual property laws.
You retain ownership of content you create (tests, questions, configurations). You grant us a license to host, display, and process your content as needed to provide the Service.
Code submitted by candidates during assessments remains the intellectual property of the candidate. Companies receive a license to review and evaluate submissions for hiring purposes only.
Our pre-built question library is licensed for use within the platform only. Questions may not be copied, redistributed, or used outside of Test Utopia without written permission.
Subscription Plans: Access to the Service requires an active subscription. Plans vary in features, included allowances, and pricing. The current plans, prices and allowances are published on our pricing page and form part of these Terms.
Billing Cycle: Subscriptions are billed in advance, monthly or annually, depending on your chosen plan, and renew automatically for successive periods until cancelled.
Free Trials: Each eligible new company may receive one 14-day self-service Test Utopia Trial after verifying a company-domain email. No payment method is required, the trial does not automatically convert to a paid subscription, and no charge is made when it expires. Unless an authorized billing user purchases a paid plan, the organization moves to the Free plan at expiry and access is reduced to the Free-plan features and allowances. Any separate sales-granted evaluation is governed by the terms shown when it is granted.
Included Allowances: Each plan includes the allowances published on our pricing page. The self-service Trial has separate fixed allowances shown before activation. Candidate invitations are not separately charged, while starts, seats, active tests, AI tokens, interview time, and other resources may be limited according to the current plan or Trial.
Usage Beyond Your Allowance: Usage above your plan allowance is charged on a pay-as-you-go basis at the rates published on our pricing page (currently EUR 0.10 per minute of live interview and EUR 0.02 per 1,000 AI tokens, exclusive of VAT). Interview time is measured on the actual duration of the live room; AI usage is measured on tokens actually consumed. We may change these rates in accordance with the Price and Allowance Changes provision below.
Pay-as-you-go Billing: Pay-as-you-go usage is postpaid. It accrues during your billing period and appears on your next invoice. We do not make separate mid-cycle charges for it.
Pay-as-you-go Is Enabled by Default: Pay-as-you-go is switched ON by default on paid plans, so that work in progress is not interrupted when a plan allowance runs out. You can switch it off at any time in your billing settings, in which case the Service stops at your plan allowance instead of accruing charges. The Free plan never accrues pay-as-you-go charges.
Spend Limit: You set a monthly pay-as-you-go spend limit, which defaults to 50% of your monthly plan price. When the limit is reached we stop permitting new chargeable usage. Usage already under way when the limit is reached completes and is charged, so the amount billed may modestly exceed the limit. We email your billing contacts as you approach it.
Changing Plans: You may request a plan change from your billing settings. Upgrades and permitted downgrades take effect according to the price and proration preview shown before confirmation. A downgrade is blocked until active users and tests fit the selected plan. Allowances are those of the new plan once the provider confirms the change, and unused allowance does not carry over unless stated otherwise.
Payment Processing: All payments are processed securely through Stripe. We do not store your full payment card details.
Invoices: Invoices are payable within 30 days of issue unless a different period is agreed in writing in an order form or master services agreement.
Price and Allowance Changes: We may adjust prices, plan allowances and pay-as-you-go rates with at least 30 days' advance notice by email. Existing billing cycles will be honored at the price already charged. If you do not accept a change, you may cancel before it takes effect.
Failed Payments: If a payment fails, we and our payment processor will attempt to retry it, and we will notify your billing contacts. Continued failure to pay may result in suspension or termination of your account under section 6.
Currency: All prices are quoted and charged in euro (EUR).
Taxes: All prices are quoted exclusive of VAT. Any VAT due is calculated at checkout based on your billing country and added to the listed price. Business customers established in the EU who supply a valid VAT identification number are zero-rated under the reverse-charge mechanism; customers established outside the EU are outside the scope of EU VAT. Each invoice states the net amount and the VAT separately.
You may cancel your subscription at any time from your billing settings. Cancellation stops auto-renewal — your access continues until the end of the current billing period, with no further charges. Any pay-as-you-go usage already accrued in that period remains payable and is billed on your final invoice. At the end of the period your account moves to the Free plan.
We may suspend or terminate your account for violations of these terms, non-payment, or other reasons at our discretion with notice.
Default policy. Subscriptions are billed in advance for each billing period. Cancellation does not generate an automatic refund for the unused portion of the current period — you retain access until the period ends.
EU consumers — statutory right of withdrawal. Consumers domiciled in the European Union have a 14-day right of withdrawal under Directive 2011/83/EU. By accepting these Terms and beginning to use the Service (including during any free trial), you expressly request immediate provisioning of the digital service and acknowledge that, in accordance with Article 16(m) of the Directive, your right of withdrawal lapses once full performance has begun.
Billing-error refunds. If you believe you have been billed in error (duplicate charge, technical issue, undisclosed price change, or extended service outage), contact [email protected] within 30 days of the charge. Eligible refunds are processed via Stripe.
Annual plans. Cancellation of an annual plan after the cooling-off period does not generate a pro-rata refund for unused months; access continues to the end of the paid year.
Enterprise customers. Refund terms for Enterprise plans are set out in the individual order form or master services agreement and may differ from this section.
Data Retention: After your subscription ends we retain your account data so that it is available to you if you return or need an export. We do not delete it automatically. You may request an export, or ask us to erase your data, at any time by contacting [email protected]; we action erasure requests within 30 days. Certain records — principally invoices and other accounting documents — must be retained for longer to meet statutory tax obligations, as described in our Privacy Policy.
As-Is Basis: The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
No Guarantee: We do not guarantee that the Service will be uninterrupted, error-free, or that defects will be corrected.
Assessment Accuracy: While we strive for accuracy, we do not guarantee that assessment results will perfectly predict candidate performance.
Third-Party Services: We are not responsible for the reliability or performance of third-party services integrated with our platform.
Limitation of Liability: To the maximum extent permitted by law, Test Utopia shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

You agree to indemnify, defend, and hold harmless Test Utopia, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any rights of another party.
These Terms are governed by the laws of the Republic of Bulgaria, without regard to conflict of law principles. The courts of Sofia, Bulgaria shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Service. Consumers domiciled in the European Union retain the right to bring proceedings in the courts of their country of residence and to invoke the mandatory consumer protection laws of that jurisdiction.
For disputes between Test Utopia and business customers — meaning companies, organizations, or any user not acting as a consumer (a natural person acting outside their trade, business, craft, or profession) — the parties may agree in writing to resolve disputes through binding arbitration administered under the rules of the Court of Arbitration at the Bulgarian Chamber of Commerce and Industry. Consumers are not bound by this arbitration provision and retain their right to bring proceedings before competent courts.
To the extent permitted by applicable law, you agree to resolve disputes with us individually and waive any right to participate in class action lawsuits or class-wide arbitration. This waiver does not apply where mandatory consumer protection law prohibits such waivers, including for consumers domiciled in the European Union.
We may modify these Terms at any time. We will notify you of changes by:
Continued use after changes constitutes acceptance of the updated terms.
Entire Agreement
These Terms constitute the entire agreement between you and Test Utopia.
Severability
If any provision is found unenforceable, the remaining provisions continue in effect.
Waiver
Failure to enforce any right does not constitute a waiver of that right.
Assignment
You may not assign your rights under these Terms without our consent.
Force Majeure
We are not liable for delays caused by circumstances beyond our reasonable control.
